Karwar: A Divisional Bench of the Supreme Court, consisting Justice Singhvi and Justice Dhruv Mukhyopadyaya, rejected the petition filed by Defense Estate Officer of the Defense Ministry, who had challenged the verdict of local court in connection with compensation to Ramdas Shirodkar, an evacuee of the Seabird Project, in New Delhi on Thursday.
Arguing for the petitioner Mr Shirodkar, senior advocate Mr Mehta told the Bench that the verdict of Karwar Senior Grade Civil Court, given in 2005, was not brought to the notice of the Supreme Court in the appeal by the Defense Estate Officer.
Expressing dissatisfaction over the matter, the Bench took the government advocate to task. The Bench also questioned as to why the case was brought to the Supreme Court instead of filling an appeal in High Court. It also questioned as to why the appeal was filed in connection with only 300 cases out of total 600 cases. The Bench upheld the judgment given by the Senior Grade Civil Court of Karwar.
Advocate K R Desai, F L Desai, F L Lobo, Seabird Evacuees Forum Honorary President Prabhakar Rane, Ravindra Amadalli, Honnapa Naik and Ganapati Mangres welcomed the decision of the Supreme Court.
